A state appeals court on Thursday upheld approval of an environmental report for California’s high-speed rail project that chose Pacheco Pass as the preferred line between the Central Valley and Bay Area.
Atherton, a Bay Area city, had challenged a ruling two years ago by Sacramento Superior Court Judge Michael Kenny that approved the environmental impact report for the section, The Fresno Bee’s Tim Sheehan reported Thursday afternoon.
The Third District Court of Appeal in Sacramento upheld Kenny’s ruling.
Kenny has also ruled against the project by denying it some $8 million in bond sales last November. That ruling is being appealed by the California High-Speed Rail Authority.
